This past October, the Third Circuit granted the state of New Jersey an en banc hearing which set aside an earlier decision that a law allowing sports betting at casinos and racetracks violates federal law.
The cases en banc review will occur February 17, 2016 and the court has advised attorneys to be prepared to argue "all issues that are ripe for review."
New Jersey pushing the discussion of sports betting is a brilliant maneuver to raise awareness at the federal level, according to Fox Rothschild's Patrick Madamba, Jr.
"I believe this ultimately leads to a political solution and that Congress will need to get involved," Madamba said. "The leagues were supportive of fantasy sports. They certainly look hypocritical here in so adamantly opposing sports betting."
