On March 31, a New Jersey District Court dismissed a putative
class action against an insurance company, which stemmed from the
theft of company laptops containing personal health information of
the company's members. Thecourt held that the plaintiffs lacked
standing and failed to sufficiently allege economic harm, noting
that an increased risk of identity theft due to a security breach
is not sufficient to grant standing under Article III.
