The Federal Claims Court recently ruled in favor of the Government Accountability Office (GAO) in regards to the construction of a U.S. embassy in Mozambique.
The construction company who was prosecuting had filed two bid protests. They thought the GAO was considering a contract with other construction companies, which would violate the Competition in Contracting Act (CICA).
The court ruled that there was insufficient evidence that there would be another contract; the GAO is allowed to entertain other bids as long as there is no such contract.
Dirk Haire who represented the construction company stated, "It would appear that the practical result of the two processes as they happened got us to the same point of relief that we were requesting. At the end of the day, what I wanted was a decision on the merits from the GAO, which it looks like we're going to get."
