In the case of K.A.F. v. D.L.M., a New Jersey appellate court recognized that a same-sex stepparent who has raised a child from a young age can seek custody or visitation with the child if it is considered to be in child's best interest. The court acknowledged that children prefer to maintain a relationship with a psychological parent, even if the child has other legal parents, and even if the psychological parent was not married to one of the parents.
