Communications Between Attorney And Expert Still Protected In Pennsylvania

I previously reported that the Pa Supreme Court accepted allocator in the Barrick v. Holy Redeemer Hospital case. The Pa Superior Court found that communications between an attorney and an expert were protected under the Work Product Doctrine. When the Supreme Court accepted the case I feared that the Supreme Court would reverse the Superior Court.

Yesterday the Supreme Court issued an order that as a result of the Court being divided the Superior Court decision was affirmed. So for right now those communications remain protected.
