A California federal judge tossed an artist's copyright-infringement suit against H&M Co. Inc., ruling that he hadn't identified any protectable, substantially similar elements between his iconic "LA Fingers" photograph and an image on a shirt sold by the Swedish clothing retailer.

The judge had booted the case in October but gave the photographer a chance to refile trimmed-down infringement claims. H&M argued that the new, amended complaint was still deficient and should be permanently tossed.
