The Attorney General of Pennsylvania filed a lawsuit earlier this month against 13 major drug companies. The lawsuit alleges that the defendants engaged in unlawful practices that forced consumers and state agencies to pay significantly higher prices for prescription drugs. The allegations involve accusations that the defendants (1) established and promoted a "spread" between what the drug companies charged for the drug and what consumers and state programs paid for the drugs; (2) provided free drug samples knowing that consumers and state agencies would be charged full price; (3) provided financial incentives, such as cash and free trips, to promote the sale of the drugs at exorbitant prices; and (4) engaged in fraudulent concealment of the scheme and conspiracy of the illegal conduct.
