Cartel Enforcement
In the area of EU cartel enforcement, issues of interest include:
- The continuing debate on parental liability and, in particular, the ramifications of the General Court ruling in the Bananas cartel
- The jurisdictional limits of EU cartel rules (our article in the European Competition Journal was cited by the US DOJ in the AU Optronics litigation)
- The risk of expanded disclosure of leniency applications to plaintiffs in civil damages actions
Merger Control
Regarding the proposed revision of merger procedures in the EU, the European Commission will soon launch a public consultation on a proposal to expand the scope of the EU Merger Regulation to acquisitions of non-controlling minority participations in competitors. Steptoe closely monitors and will report on this important topic in the coming weeks.
Abusive Conduct
In relation to abusive conduct by a dominant company, much of the focus is on the ongoing investigations against Samsung and Motorola, where the European Commission is examining whether seeking injunctive relief in civil courts against would-be licensees of SEPs may constitute an abuse under Article 102 TFEU.
