In most community associations, the ByLaws for the condominium or homeowners associations set forth that during an election, judges will be appointed to inspect and review ballots and make determinations as to the validity of the ballots. The judges also tabulate the votes for the issues or candidates being voted upon by the membership. Commonly, these same ByLaws will call for an oath to be given and sworn to by these appointed election judges. However, in many cases, no such oath is provided in the Bylaws. Therefore, to assist your association, I have found that the following is an excellent oath to be used:

"I, [state your name] do solemnly swear and affirm that I will impartially discharge the duties of Election Judge for [insert the name of the Association] to the best of my ability. Further, I will identify and count the votes of the qualified voters in an accurate and honest manner and that I will preserve the secrecy and integrity of the balloting and that I will not disclose how any voter voted unless required to do so as a witness in a proper judicial proceeding."

The above form should be sufficient for any possible oath that would be needed by your association. However, if your own governing documents provide you with specific language, you should defer to that specific language.
