Today the U.S. Court of Appeals for the District of Columbia Circuit granted a request by the National Association of Manufacturers and other employer groups for an injunction pending their appeal of the National Labor Relations Board's final rule requiring all employers subject to the NLRB's jurisdiction to post a notice advising employees of their rights under the National Labor Relations Act. The court's order postpones the effective date of the Board's posting rule and preserves the status quo until the court decides the pending appeal of the March 2 decision by the federal district court in Washington, D.C. That court upheld the posting requirement, but struck down two of the rule's penalty provisions. The Court of Appeals also set an expedited briefing schedule with briefing to be completed by June 29, and oral argument set for a date to be decided in September.
