An overview of notable decrees by the Council of Ministers and communiqués by the Ministry of Economy regarding prevention of unfair competition in imports, made during August 2016. 

Anti-Dumping Duty Placed On Seamless Drawn Pipes Imported from China 

The Import General Directorate of the Ministry of the Economy initiated a dumping investigation upon receiving an application from a local producer, Sardoğan, supported by Tufanoğlu Boru Metal Mak. San. ve Tic. Ltd. Şti. with the Communiqué on Unfair Competition Prevention in Imports numbered 2016/35 ("Communiqué"). As a result, the Import General Directorate decided to impose definitive measure on imports of "seamless drawn pipes made of iron (cast iron excluded) and steel" from the People's Republic of China. The measure entered into effect by being published in Official Gazette number 29791 on 4 August 2016.

Anti-Dumping Duty on Bicycle Tyres and Tubes Will Continue with Amendments 

The Import General Directorate of the Ministry initiated an expiry revision investigation, upon receiving an application by Anlaş Anadolu Lastik San. ve Tic. A.Ş.. The Import General Directorate decided to continue existing definitive measures, with some amendments.

Accordingly, definitive measures will continue to apply to "bicycle tyres and tubes" imported from the Chinese Taipei, Vietnam and Sri Lanka classified under tariff codes 4011.50.00.00.00 and 4013.20.00.00.00.

However, the scope of measures will be extended to include tyres and their parts and accessories classified under the tariff code 8714.92.10.00.00; in relation to the products under tariff codes 4011.50.00.00.00 and 4013.20.00.00.00.

The addition is made as a result of the Ministry of Customs and Trade's official opinion about inconsistent practices under current measures, arising from the statement "whether or not attached to the rims under the tariff code 8714.92.10.00.00 (rims excluded)".

The measure entered into effect by being published in Official Gazette number 29798 on 11 August 2016.

Beef Imports from Bosnia-Herzegovina Will Benefit From Tariff Quotas 

To provide financial support to Bosnia-Herzegovina, which has been effected by flooding, the Turkish Council of Ministers decided that beef imports from Bosnia-Herzegovina should benefit from tariff quotas allocated for the General Directorate of the Meat and Milk Authority.

The Council of Ministers' decree on the principles regarding the application of the tariff quotas dated 27 June 2016 and numbered 2016/8993 ("Decree") entered into effect by being published in Official Gazette number 29790 on 3 August 2016.

Goods which fall into meet either of the following categories will benefit from the tariff quotas:

  • Goods derived from livestock bred and raised in Bosnia-Herzegovina and classified under the tariff codes 0201 and 0202; and
  • Goods derived from livestock bred and raised outside of Turkey or Bosnia-Herzegovina, and butchered after a three-month minimum cultivation period in Bosnia-Herzegovina and classified under the tariff codes 0201 and 0202

If neither of these criteria are not met, the country where the livestock bred or had the longest period of cultivation will be considered to be the country of origin.

The Decree stipulates that the products imported from Bosnia-Herzegovina will only benefit from the tariff quotas upon presentation of EUR.1 Movement Certificate.
