Kazakhstan Intellectual Property

According to the Decree of the Cabinet of Minister No. 810 from 09 October 2017, starting from 12 October 2017 on all patent and other fees to be paid to the Agency shall be paid only in national currency of the Republic of Uzbekistan (Uzbek som).

This also applies to fees paid for registration of international trademarks under the Madrid Protocol.

As of 23 October 2017, there is no information on the Agency's website about this new rule, and instructions as to its implementation, but it is supposed that all the previously made payments will be accepted by the Agency for current procedural actions based on the official exchange rate set by the Central Bank.

Based on the above, our recommendation to all foreign (non-resident) right holders and applicants is to amend existing Power of Attorneys issued for their representatives (Patent and Trademark attorneys) and explicitly authorize them with the right to pay patent and other fees in national currency for and on behalf of the right holders and applicants.

From our side we express our willingness to deal with the Agency on all kind of matters, including urgent payment of patent and other fees in the national currency.
