Updates to Canada’s Environmental Health and Safety Laws and Policies

Hear leading experts discuss emerging trends and latest developments to Canada’s Environmental Health and Safety Laws and Policies. Topics to be discussed include:

  • A discussion of recent amendments to the Conservation Authorities Act and the new Ontario Regulation 41/24, intended to clarify regulatory requirements and increase transparency, while enhancing enforcement powers.
  • A discussion of the Supreme Court of Canada’s decision in R v Sudbury (City), 2023 SCC 28 and its ramifications for owners and other workplace parties on construction projects.
  • An overview of the new fine regime under the Ontario OHSA, including increased maximum fines for corporations ($2-million) and corporate directors and officers ($1.5-million).
  • Update on recent decisions and developments with respect to director and officer liability for environmental offences, including a discussion of the recent R v Mossman and Meckert, 2023 BCPC 157 decision
  • A discussion of the recent decision from Qualex-Landmark Towers Inc v 12-1- Capital Corp, 2023 ABKB 109 and the potential creation of a common law super priority for environmental obligations between private parties

  • The employer’s new obligations regarding the prevention of harassment and violence in the workplace, as mandated by Bill 42, An Act to prevent and fight psychological harassment and sexual violence in the workplace, adopted in March 2024.
