February 22, 2024 - 1:00 PM - 2:00 PM

Over the last few years, we have seen a notable increase in consumer protection class actions across Canada. As a result, the body of case law addressing certification issues raised by these actions has grown considerably.

Please join members of our national Class Actions team for a discussion on the latest developments in the Canadian consumer protection class actions space. This session will examine a selection of 2023 decisions and address some of the key issues in consumer protection class actions, including possible impacts of the new Ontario Consumer Protection Act, 2023. A brief Q&A session will follow the presentation.

Topics:

  • Update on certified actions that ultimately failed for lack of merit and/or largely failed at certification.
  • The ongoing causation requirement debate.
  • A brief refresh on the BCCA decisions regarding arbitration.
  • Provincial differences with respect to privity.
  • Claims based on unconscionable practices.
  • A Quebec perspective on these common law developments.
  • The new Consumer Protection Act in Ontario.
