On April 26, 2010, in a 6-5 decision, an en banc panel of the Ninth Circuit affirmed in large part a district court’s certification of an employment discrimination class action involving claims for declaratory and injunctive relief, back pay, and punitive damages asserted on behalf of a class of about 1.5 million people, "encompassing all women employed by Wal-Mart at any time after December 26, 1998."
