Mexico: Iniciativa de reforma a la Ley de la Propiedad Industrial en materia de Marcas

Con fecha 3 de abril de 2018 en Sesión Ordinaria y por unanimidad; el Senado de la República aprobó la Iniciativa que reforma y adiciona diversas disposiciones de la Ley de la Propiedad Industrial y dicha reforma fue turnada al Ejecutivo Federal para su publicación en el Diario Oficial de la Federación.

En Clarke Modet & Co. México, tenemos el agrado de comunicarles a todos nuestros importantes clientes que hemos estado participando en los debates que se han venido realizando para la modificación de la Ley de la Propiedad Industrial. De la iniciativa que actualmente se encuentra en proceso de publicación queremos compartirles los puntos más relevantes de la misma para su conocimiento:

La iniciativa tiene por objeto modificar la Ley de la Propiedad Industrial, en relación a ampliar los conceptos de marca, marcas colectivas y marcas notoriamente conocidas y famosas, así como incluir las marcas de certificación, conforme a lo siguiente:

1) Reforma del artículo 87: Precisar que cualquier persona, física o moral, podrá hacer uso de marcas en la industria, en el comercio o en los servicios que presten.

2) Reforma del artículo 88: Marca como nueva definición: "todo signo perceptible por los sentidos y susceptible de representación gráfica, que distinga productos o servicios de otros de su misma especie o clase en el mercado." Esta nueva definición conlleva la susceptibilidad a registro de Marcas "No Tradicionales" como las marcas sonoras, olfativas y holográficas.

3) Se incluye en la ley la figura de la "Distintividad Adquirida" que, en virtud del criterio de la autoridad, las marcas que sean consideradas como descriptivas o carezcan de distintividad, podrán ser sujetas a registro como resultado de su uso en el comercio.

4) Indicar que podrán solicitar el registro de una marca colectiva, las asociaciones o sociedades de productores, fabricantes o comerciantes de productos o prestadores de servicios legalmente constituidas, para distinguir en el mercado los productos o servicios de sus miembros siempre que éstos posean calidad o características comunes entre ellos y diversas respecto de los productos o servicios de terceros.

5) La reforma regula el registro del uso de las Marcas Colectivas y de las Marcas de Certificación (El concepto de marca de certificación también parte de la definición de "marca", en tanto que su objetivo es distinguir servicios y productos, pero permite a las empresas o personas usar una marca más, además de su marca individual, a fin de garantizar al público consumidor que los productos o servicios de las marcas ya certificadas presentan características especiales).

6) Se incluye la opción de que las indicaciones geográficas puedan protegerse como marcas de certificación, sin que estas pierdan su naturaleza. Con ello, se crea un sistema de protección equilibrado entre las marcas, las indicaciones geográficas y las denominaciones de origen.

7) Se incluye un periodo de alegatos en relación al procedimiento de Oposición.

8) Se establece la figura de "Comprobación o Declaración de Uso", el cual consiste en demostrar el uso real de la marca en territorio nacional. Dicha comprobación o declaración de uso, deberá ser presentada ante el Instituto durante los tres meses inmediatos siguientes al tercer año de vigencia del registro. A falta de comprobación, procederá la caducidad del registro.

9) Se establece que, al solicitar la renovación de la marca, se deberá presentar la declaración del uso de la misma.

10) Se deroga el supuesto contenido en el artículo 115 relativo a las leyendas no reservables.

11) Reforma del artículo 183: Todas las notificaciones serán expedidas a través de la Gaceta de la Propiedad Industrial.

12) Se modifican los plazos en relación al artículo 151 (Solicitud de Declaración Administrativa de Nulidad) quedando como sigue: Plazo de 5 años a partir de la publicación en la Gaceta para ejercitar la Nulidad, de acuerdo a lo previsto por la fracción II (semejanza en grado de confusión), III (datos falsos en la solicitud) y IV (error o inadvertencia). Para ejercitar la Nulidad con base a lo previsto por la fracción I (contravención a disposiciones de ley), V (el agente autorizado en el extranjero, solicite registro sin autorización del titular) y la fracción adicionada VI (obtener el registro de mala fe) se podrán ejercitar en cualquier tiempo.

Mondaq shall use its reasonable endeavours to make the Website and Services available to you at all times, but we cannot guarantee an uninterrupted and fault free service.

Mondaq reserves the right to make changes to the services and/or the Website or part thereof, from time to time, and we may add, remove, modify and/or vary any elements of features and functionalities of the Website or the services.

These Terms shall be governed by and construed in accordance with the laws of England and Wales and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute which may arise out of or in connection with these Terms. If you live outside the United Kingdom, English law shall apply only to the extent that English law shall not deprive you of any legal protection accorded in accordance with the law of the place where you are habitually resident ("Local Law"). In the event English law deprives you of any legal protection which is accorded to you under Local Law, then these terms shall be governed by Local Law and any dispute or claim arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts where you are habitually resident.

You may print and keep a copy of these Terms, which form the entire agreement between you and Mondaq and supersede any other communications or advertising in respect of the Service and/or the Website.

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right. Rather, any such waiver or release must be specifically granted in writing signed by the party granting it.

If any part of these Terms is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the Terms shall continue in full force and effect.

Mondaq shall not incur any liability to you on account of any loss or damage resulting from any delay or failure to perform all or any part of these Terms if such delay or failure is caused, in whole or in part, by events, occurrences, or causes beyond the control of Mondaq. Such events, occurrences or causes will include, without limitation, acts of God, strikes, lockouts, server and network failure, riots, acts of war, earthquakes, fire and explosions.
