After the guidelines issued for computer related inventions (CRI), later on 12th August, 2014, Indian Patent office published their revised guidelines for examine the patent application in the field of Pharmaceuticals. Considering the importance of Pharmaceutical patenting which is an extremely important aspect of India's Patent system these revised guidelines will play an important role for inventors and to the Patent examiners as well to the patent.
These guidelines are supplemental to the practices and procedures followed by the Patent Office as published in the 'Manual of Patent Office Practice and Procedure', "Guidelines for Examination of Biotechnology Applications" and the "Guidelines for Processing of Patent Applications relating to Traditional Knowledge and Biological Material". Some of the important provisions covered under these guidelines include Section 2, Section 3, claims of pharmaceutical inventions etc...
The present guidelines are prepared with the objective that the Guidelines will help the examiners and the Controllers of the Patent Office in achieving consistently uniform standards of patent examination and grant.
