Germany: Anspruch auf Zahlung von Pauschalen bei Verzug des Arbeitgebers?

Arbeitnehmer haben keinen Anspruch auf Zahlung von Pauschalen nach § 288 Abs. 5 BGB bei Verzug des Arbeitgebers mit der Entgeltzahlung.

BAG, Urteil v. 25.09.2018 – 8 AZR 26/18

In dem jetzt vom BAG entschiedenen Rechtsstreit verlangte der Kläger wegen verspäteter Entgeltzahlungen die Zahlung von Pauschalen nach § 288 Abs. 5 BGB. Der Kläger ist langjährig bei der Beklagten beschäftigt. Er hat diese auf Zahlung rückständiger Besitzstandszulagen für die Monate Mai bis September 2016 in Anspruch genommen. Zudem hat der Kläger von der Beklagten wegen Verzugs mit der Zahlung der Besitzstandszulage für die Monate Juli bis September 2016 die Zahlung von drei Pauschalen á 40,00 EUR nach § 288 Abs. 5 BGB verlangt.

Arbeits- und Landesarbeitsgericht haben dem Kläger auch die verlangten Pauschalen zugesprochen. Im Zuge der Umsetzung der EU-Richtlinie 2011/7/EU vom 16.02.2011 hatte der deutsche Gesetzgeber durch das Gesetz zur Bekämpfung von Zahlungsverzug im Geschäftsverkehr" vom 22.07.2014 § 288 Abs. 5 BGB neu gefasst (vgl. SKW Newsletter, Aktuelles aus dem Arbeitsrecht, Oktober 2016, Seite 2/11). Danach hat der Gläubiger einer Entgeltfortzahlung bei Verzug des Schuldners, wenn dieser kein Verbraucher ist, Anspruch auf Zahlung einer Pauschale in Höhe von 40,00 EUR. Da der Arbeitgeber in der Regel kein Verbraucher ist, war damit die Anwendung von § 288 Abs. 5 BGB auch für Vergütungsansprüche des Arbeitnehmers gegeben. Für Altverträge sollte die Regelung aber erst ab 01.07.2016 gelten.

Die in § 288 Abs. 5 BGB geregelte Pauschale soll ein Ausgleich für Ärger und aufgewendete Arbeitszeit des Gläubigers sein. Nicht erforderlich ist ein materieller Schaden. Der materielle Schaden wird u.a. durch Verzugszinsen kompensiert.

Die Anwendung des § 288 Abs. 5 BGB im Arbeitsrecht stieß von Anfang an auf deutliche Kritik. Dieser Kritik hat sich nun das BAG in relativ kurzer Zeit angeschlossen mit Hinweis auf § 12 a Abs. 1 Satz 1 ArbGG. Diese Vorschrift bestimmt, dass in Urteilsverfahren beim Arbeitsgericht kein Anspruch der obsiegenden Partei auf Entschädigung wegen Zeitversäumnis und auf Erstattung der Kosten für die Zuziehung eines Prozessbevollmächtigten oder Beistands besteht. Das BAG hat entschieden, dass diese spezielle arbeitsrechtliche Regelung nicht nur einen prozessualen Kostenerstattungsanspruch wegen erstinstanzlich entstandener Beitreibungskosten, sondern auch einen entsprechenden materiellrechtlichen Kostenerstattungsanspruch und damit auch den Anspruch auf Pauschalen nach §  288 Abs. 5 BGB ausschließt.


Nach der Entscheidung des BAG können Arbeitnehmer bei Zahlungsverzug des Arbeitgebers Verzugszinsen in Höhe von 5 Prozentpunkten über dem Basiszins p.a. (derzeit -0,88 % also im Ergebnis 4,12 %) verlangen, so dass fristgerechte Zahlungen zu empfehlen sind.
