The Department of Merchant Shipping recently announced the issuance of the Merchant Shipping (Marine Equipment) Order 2013 (PI 366/20131) and the Merchant Shipping (Marine Equipment) Notification 2013 (PI 365/20132), under the Merchant Shipping (Marine Equipment) Law (55(I)/2002, as amended).

The Department of Merchant Shipping recently announced the issuance of the Merchant Shipping (Marine Equipment) Order 2013 (PI 366/20131) and the Merchant Shipping (Marine Equipment) Notification 2013 (PI 365/20132), under the Merchant Shipping (Marine Equipment) Law (55(I)/2002, as amended).

The new order and notification transpose the revised EU Marine Equipment Directive (2012/32/EC, amending Directive 96/98/EC) into law in Cyprus. The new order replaces Schedule A of the Marine Equipment Law with a new Schedule A that is identical to Annex A of the directive. The new notification defines the scope of the equipment subject to Section 6(3) of the law.

In accordance with Article 2 of the directive, any equipment listed in Column 1 of Annex A.1 as either a 'new item' or one transferred from Annex A.2, where such equipment was manufactured before November 30 2013 in conformity with procedures for type-approval already in force before that date within the territory of a member state, may continue to be placed on the market and onboard a Cyprus ship or EU ship until November 30 2015.

The order and notification took effect from November 30 2013.
