Ce sont de bonnes nouvelles pour les détenteurs de brevets et les compagnies innovatrices, notamment parce que ce mécanisme d'invalidation, qui a mené à l'invalidation de plusieurs brevets importants, ne sera plus disponible. Quant à la législation, c'est la mise en Suvre du nouveau Règlement sur les médicaments brevetés (avis de conformité) en vertu duquel des parties doivent dorénavant procéder par des actions qui fourniront une décision finale de contrefaçon et de validité, et non par des demandes qui avaient effet seulement entre des parties.
