Canada: Stratégie En Matière De Compétences Mondiales En Faveur Des Travailleurs Hautement Qualifiés | L'Espace RH

Le 12 juin 2017, Immigration, Réfugiés et Citoyenneté Canada (IRCC) a mis en place sa Stratégie en matière de compétences mondiales (SMCM), programme visant à favoriser la croissance des entreprises et des universités canadiennes par l'entremise du recrutement de travailleurs qui possèdent une formation de pointe et des compétences recherchées au Canada.

Ce programme comporte 3 volets pertinents pour les employeurs : (i) une dispense de permis de travail pour certains travailleurs, (ii) un traitement rapide de certaines demandes de permis de travail et (iii) le volet des Talents mondiaux géré par Service Canada.

i. Dispense de permis de travail

Le Canada facilite désormais l'arrivée temporaire des travailleurs étrangers hautement qualifiés (CNP 0 et A) qui sont affectés pour une durée de séjour limitée, variant entre 15 jours par période de six mois ou de 30 jours par année, auprès d'un employeur local. Sont visés également par cette initiative les chercheurs étrangers qui participent à un projet de recherche au Canada. Toutefois, le délai de séjour au Canada est augmenté à 120 jours par année pour le travailleur étranger qui vient au Canada dans le cadre d'un projet de recherche piloté par une université canadienne ou son établissement de recherche affilié.

ii. Délai de traitement rapide

Le gouvernement accorde désormais un traitement rapide de 10 jours ouvrables pour plusieurs demandes de permis de travail présentées dans les bureaux de visas canadiens à l'etranger pour des travailleurs étrangers et les  membres de leur famille à charge qui les accompagnent (époux ou conjoint de fait et enfants). Ce traitement accéléré est réservé à 2 types de demandes : (i) les demandes de permis de travail dispensés d'une Étude d'impact sur le marché du travail (EIMT) qui respectent certaines conditions et (ii) les demandes de travailleurs détenant une EIMT positive émise dans le cadre du Volet des talents mondiaux.

Concernant les permis dispensés d'EIMT, l'offre d'emploi au Canada doit viser un poste de gestion ou un poste professionnel de haut niveau de compétence pour lequel un diplôme universitaire est généralement requis. De plus, le permis de travail émis doit être lié à un employeur donné et cet employeur devra avoir déposé l'offre d'emploi dans le portail des employeurs d'IRCC et payé les frais de 230$ relatifs à la conformité.

Comme pour la plupart des autres demandes de permis de travail, le travailleur devra satisfaire aux exigences académiques et professionnelles de l'emploi offert.  Dans certains cas, il devra également se conformer au prélèvement des données biométriques et à un examen médical. Ces étapes devront être effectuées avant le dépôt de la demande afin de bénéficier du traitement rapide.

iii. Volet des talents mondiaux  

Ce volet du programme contient 2 catégories permettant à des employeurs d'embaucher des travailleurs étrangers spécialisés.

  • La Catégorie A vise les entreprises au Canada qui ont été dirigées vers ce programme par un partenaire désigné par Service Canada, notamment en raison de leur caractère innovateur ou par leur capacité à démontrer le besoin d'embaucher des travailleurs étrangers temporaires spécialisés pour accroître leurs activités.
  • La Catégorie B vise les entreprises au Canada qui ont besoin d'embaucher des travailleurs étrangers hautement qualifiés dont le poste apparaît sur une liste définie de professions dans des domaines où Service Canada juge qu'il existe une pénurie de main d'Suvre au Canada. À ce jour, cette liste inclut certains analystes et ingénieurs en informatique; des analystes et administrateurs de données; des ingénieurs en logiciel; des développeurs en médias interactifs; des concepteurs Web; des technologues en génie électronique et électrique; et des designers dans le domaine des médias numériques.

Il s'agit là de professions à haut salaire (80 000$ et plus) nécessitant généralement un minimum de cinq années d'expérience ainsi qu'un diplôme d'études spécialisé en lien avec le domaine d'emploi. Le salaire offert quant à lui doit correspondre au salaire médian offert pour cet emploi au Canada dépendamment du profil et des années d'expérience du travailleur étranger.

Les employeurs canadiens qui ont recours au Volet des talents mondiaux doivent élaborer un Plan des avantages relatifs au marché du travail qui inclut des engagements mesurables de la part de l'employeur à générer des effets positifs à long terme sur le marché du travail. Ces engagements varient selon la catégorie A ou B du Volet des talents mondiaux utilisées. On distingue les avantages obligatoires et les avantages complémentaires.

Dans une demande de la catégorie A, l'employeur doit s'engager à créer des emplois, directement ou indirectement, pour les Canadiens et les résidents permanents dans le cadre de son avantage obligatoire. Dans la catégorie B, l'employeur canadien doit s'engager à augmenter ses investissements dans le perfectionnement des compétences et la formation destinés aux Canadiens et aux résidents permanents, toujours dans le cadre de son avantage obligatoire.

S'ajoutent à cela un minimum de deux (2) activités distinctes jugées à titre d'avantage complémentaire au Plan des avantages. Ces activités doivent viser par exemple la création d'emplois, l'investissement dans le perfectionnement des compétences et la formation, le transfert des connaissances au profit des Canadiens et des résidents permanents, la  croissance du rendement de l'entreprise ou la mise en Suvre de meilleures pratiques et politiques au sein de l'entreprise pour son personnel.

En matière d'efforts de recrutement, ce programme ne comporte aucune exigence minimale mais l'on invite les employeurs à déployer des efforts raisonnables de recrutement de Canadiens ou  résidents permanents avant d'offrir le poste à un travailleur étranger et à décrire ces efforts dans leur demande. Enfin, comme pour les autres demandes de permis de travail, l'employeur demeure sujet à l'obligation de conformité des employeurs quant au respect des conditions de travail offertes dans la demande et ce, sous peine des sanctions à la hauteur de l'infraction commise.

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right.
