Advertising Standards Canada has released its new Guidelines for the Nonprescription and Cosmetic Industry Regarding Non-therapeutic Advertising and Labelling Claims (the "Guidelines"). The Guidelines were developed in an effort to assist marketers and advertisers in differentiating between non-therapeutic/cosmetic claims and therapeutic/health claims, the latter of which require Health Canada's approval prior to market authorization. The Guidelines set out various non-therapeutic hair, nail and skin care claims which do not require Health Canada's prior authorization.
