Since my post on October 21, 2013 entitled "Consent and Anti-Spam: Why Compliance with Privacy Laws May Not be Sufficient for CASL", the Canadian government has released final regulations to Canada's anti-spam law ("CASL") and confirmed the date that CASL will come into force.

Although the Canadian Radio-television and Telecommunications Commission ("CRTC") did not issue new guidelines for obtaining consent under CASL, it issued some further explanation with respect to obtaining consent and proving that consent has been obtained. It is important for not for-profits and charities to evaluate any consent requirements that CASL may place on them and start preparing now to ensure proper consent is in place by July 1, 2014.
