Human resource professionals are generally well aware of the protected leaves of absence that are provided for by employment standards legislation, including pregnancy / maternity leaves of absence, parental leaves of absence, and personal emergency / sick / family medical leaves of absence. However, issues often arise with respect to an employee's entitlements during a protected leave of absence as well as their entitlements upon the conclusion of that leave of absence.

This paper will provide an overview of who is entitled to pregnancy / maternity, parental and personal emergency / sick / family medical leaves of absence. It will also address an employer's obligations both during a protected leave of absence and following the conclusion of the protected leave of absence.
