Canadian workplaces and the laws that govern them are undergoing a slow but certain evolution in the way that mental health issues are perceived and addressed. Employers are increasingly – even regularly – being called upon to deal with a wide variety of mental health issues in the workplace, including stress-related disability claims, workplace bullying and harassment and, tragically, violence up to and including physical assault and murder.

In this paper, Davis LLP's Dan Black and Karen Bock use select case studies to provide an overivew of legal protections for workplace mental well-being offered under Canadian human rights law, workers' compensation law, arbitral and labour law, and the common law.

Presented at the annual Davis LLP Toronto Employment and Labour Law Conference on May 10, 2013.
