Na sessão de julgamentos do STJ do dia 23 de fevereiro de 2016 três dos cinco ministros da 1ª Turma do STJ votaram a favor da utilização de uma base de cálculo de ICMS diferenciada nas vendas de medicamentos a hospitais.
A discussão se refere a uma autuação fiscal lavrada pelo Estado da Bahia alegando recolhimento a menor de ICMS, pois o contribuinte utilizou preços menores que os sugeridos nas revistas ABCFarma e Guia da Farmácia e na Portaria nº 37/92, do Ministério da Fazenda, que orientam o valor dos remédios vendidos nas farmácias.
O julgamento foi interrompido por um pedido de vista do Ministro Sérgio Kukina.
