On October 24, 2015, Decree No. 56,539/2015 was published in the Official Gazette of the City of São Paulo. The Decree reopened the application period for the Payment Program established by São Paulo Municipal Ordinance No. 16,097/2014.
The Program applies to tax and non-tax liabilities, whether assessed or not, including past due debts, where the tax events occurred prior to December 31, 2014, with reductions in penalties and interest. The Program also applies to debts already under a payment plan from a previous amnesty program.
The Payment Program allows debts to be paid in a lump sum or in up to 120 monthly installments.
Tax liabilities can be paid: (i) in a single installment, with an 85% reduction in interest and a 75% reduction in fines; or (ii) in up to 120 installments, with a 60% reduction in interest and a 50% reduction in fines.
The application period for the Amnesty Program runs from November 1, 2015 through December 14, 2015. However, for debts already subject to a previous Tax Amnesty payment plan, the application period ends December 4, 2015.
As usual, application to the Program is conditioned on assuming the debt and waiving the right to pursue any administrative or judicial relief otherwise available.
