The Australian Government has recently approved changes to certain patent, trade mark and design fees.

A summary of the most significant changes in structure and fees is provided at https://www.ipaustralia.gov.au/about-us/news-and-community/official-notice/fee-changes-ip-australia-fee-review-update

IP Australia states that the aim of the changes is to provide a simpler fee structure for customers and to bring IP Australia into line with other international IP offices.

The changes are proposed to take effect from 10 October 2016, subject to amending regulations being made.

Changes to the application and renewal fees of international trade mark applications through the Madrid Protocol designating Australia are scheduled to take effect from 28 October 2016.

Importantly, Australian Government trade mark application fees will increase to $330 per class, and renewal fees will increase to $400 per class. This will increase the upfront fee substantially, but will be offset by the removal of the current registration fee therefore reducing the overall cost of registering a trade mark in Australia.
