As noted in our article titled " What's in the nature of a bully?" dated 19 June 2013, we promised to keep our readers updated as to the progress of the proposed anti-bullying amendments.

Just over one week after our article, on 27 June 2013 Federal Parliament passed the new laws, with the Fair Work Amendment Act No 73 2013 (Cth) receiving Royal Assent on 28 June 2013.

The new anti-bullying laws will come into effect from 1 January 2014. Accordingly over the next few months employers should ensure they get their houses in order and update/review any bullying/harassment/discrimination policies and associated work health and safety policies (or develop them where none presently exist).

In addition to the anti-bullying provisions, there have also been changes to special maternity leave, parental leave and rights to request flexible work, all of which are now in force, effective 1 July 2013. Existing policies should be reviewed in light of these changes as the changes provide broader entitlements to employees. Other provisions in force from 1 January 2014 include requirements to genuinely consult with employees regarding roster/working hour changes.
