In Seaman v BAE Systems Australia Logistics Pty Limited, FWA upheld the decision by BAE Systems Australia Logistics Pty Limited, to dismiss an employee for serious misconduct where he had called a colleague 'a f...ing nigger'. When asked to repeat what he had said, the employee then did so. Commissioner Roberts commented that the use of the racial slur was appalling and that the decision to dismiss was 'proportionate and appropriate' in the circumstances.
