Justice Daubney of the Queensland Supreme Court has upheld the effectiveness of a "bodily injury" exclusion in a professional indemnity policy taken out by a real estate agent / property manager. The policy was held not to cover a personal injuries claim brought by a tenant. The decision highlights the importance for all professionals to check that their insurance policies will respond to the ordinary risks of their professional activities.
