Federal Trademark Application Checklist

Guideline to the Federal Trademark Application.

- Written Application

  • Applicant's name, address, citizenship, etc.
  • Statement that applicant is using the mark or that applicant has a bona fide intent to use the mark
  • Date of first use (if applicable)
  • Description of the goods and services with which the mark is/ will be associated

- Declaration stating (1) that the applicant believes herself to be the owner of the mark and (2) that the mark is in use in commerce or that applicant has a bona fide intent to use the mark in commerce

- Drawing of the Mark

- Specimen Showing Use of the Mark in Commerce (if applicable)

  • For Goods:
  • Acceptable Specimens: Mark on goods themselves, mark on tag attached to goods, mark on packaging for goods, mark on display associated with goods

    Unacceptable Specimens: Mark on invoice, order form, brochure, business card, or other promotional materials

  • For Services: Screen shot of website showing mark, sign, brochure, etc.
