Uruguay: Abusos En Las Redes Sociales: Como Denunciarlos

Como usuarios de Facebook, Twitter, Instagram y de las redes sociales engeneral, siempre tenemos la sensación de inseguridad en relación a nuestrosdatos personales y demás.

Son tantos los casos de abusos registrados a nivel mundial que cada vezson más las normativas que buscan limitar los ilícitos informáticos. Tales son loscasos ocurridos en nuestro país en los últimos meses, en los cuales los delitosinformáticos, más precisamente los delitos de extorsión, han subidoconsiderablemente, siendo Facebook una herramienta que utilizan los hackerspara ingresar a los datos de la cuenta bancaria de las personas y de esta mareraacceder a su información y vaciar sus cuentas.

Hay que entender que varias leyes han calificado como delitos a lasconductas abusivas en las redes sociales, como puede ser la difamación, laextorsión, los perjuicios al buen nombre o la imagen de las personas, ladivulgación de fotografías o documentos reservados o privados, el plagio, lasuplantación de identidad, el acoso, la discriminación, las estafas. Delitos que secometen utilizando o valiéndose de las redes sociales y de la exposición enInternet.

La limitación a una sanción penal de estas conductas no es lo único.Porque también existen repercusiones en la responsabilidad civil de quienesafectaron al damnificado, que los obligará a pagar los daños y los perjuicios quehaya causado.

Ahora bien, la pregunta es, ¿Qué debemos hacer si me insultan oamenazan por las redes sociales, si roban mis datos personales sin miconsentimiento, si adulteran imágenes o datos, etc.?

En nuestro país existen medidas para evitar dichos ilícitos informáticos,pero no siempre es suficiente, ya que los usuarios no toman las cautelasnecesarias.

Debido a todo lo anterior, nos parece importante dar algunas herramientasbásicas que permitan conocer las distintas vías que hay para defenderse contralos abusos y los perjuicios a través de las redes sociales.

La primera acción ineludible es denunciarlo ante losadministradores de la red social.

Cuando nos encontramos frente a un abuso, en primer lugar, lo que sedebe hacer en es denunciar el hecho, poniéndolo en conocimiento de losadministradores de la red social en cuestión. Todas tienen políticas para prevenir ysancionar los abusos de los usuarios, y habilitan medios electrónicos para reportarlos casos directamente a personas o equipos que se dedican a esas actividades.

Por ejemplo, Twitter establece las siguientes conductas abusivas objeto deposible denuncia:

  • Texto Ofensivo, irrespetuoso o en desacuerdo con mi opinión
  • Acoso
  • Amenazas violentas específicas relacionadas con el bienestar o laseguridad física
  • Información o foto privada expuesta
  • Un usuario de Twitter está publicando spam

En este caso, hay que reportar la situación al administrador por medio de laweb del propio servicio (https://support.twitter.com/forms/abusiveuser).

Sin embargo este no es un paso sencillo, ya que muchas de estasdenuncias nunca son tenidas en cuenta por los administradores, cuya sedes seencuentran muchas veces de manera remota o lejana, o en otros idiomas, o contiempos de respuesta que pueden hacer inútil cualquier esfuerzo que requierainmediata solución.

Presentar la denuncia ante las autoridades policiales.

En nuestro país se han creado departamentos específicos dedicados a lainvestigación de los delitos cometidos en las redes sociales, tal como la DirecciónGeneral de Crimen Organizado e INTERPOL. Es conveniente solicitar que losmismos intervengan, para hacer más eficaz nuestra denuncia.

Los mismos, se dedican a investigar, prevenir, controlar y reprimir los ilícitosinformáticos, ya sea en Facebook, Twitter o cualquier otra red social. Se encargana su vez, de llevar un registro de todas aquellas personas que cometen ilícitos deesta índole.

Aunque es posible formular denuncias por medios electrónicos, incluso demanera anónima, la gestión directa resultará esencial en la mejor resolución delcaso, especialmente por detalles o elementos que solo el afectado conoce opuede aportar.

Intervención de la justicia por denuncia del damnificado

Los afectados por el abuso o uso indebido de la red social puedeninterponer la denuncia directamente ante el Poder Judicial. Se debe describir elhecho de la forma más minuciosamente posible y hay que acompañar losdocumentos o pruebas que se tengan de la manera que no se puedan eliminar oalterar.

Para evitar que el delincuente borre o destruya pruebas hay quepreservarlas con intervención profesional.

La celeridad y prontitud de las presentaciones que deben hacerse ante eljuzgado son fundamentales para evitar que el daño se siga expandiendo y setransforme en una situación de mayor dificultad, como por ejemplo que circule porInternet, otras redes sociales o incluso que se hagan públicas fuera de ese ámbito(ejemplo, grabaciones, fotos, etc.).

El abuso que causa daño a la víctima debe estar enmarcado en elconocimiento exacto de los derechos que tiene a su disposición. Es preciso quehaya un asesoramiento especializado y eficaz que conjugue la celeridad y laspruebas que se solicitan en estos casos.

Para que se configure, se pruebe y la justicia actúe debe tenerse claro elmarco legal que existe en nuestro país a tales efectos, como es por ejemplo la ley18.331 que hace referencia a la protección de datos personales y la acción de "habeas data".

Por otro lado, el asesor le podrá auxiliar y orientar en las accionesinmediatas y en las pruebas adecuadas.

Es de suma importancia que el abogado tenga conocimiento del tema,porque de otra forma no reunirá la información suficiente parahacer eficaz ladenuncia sobre el hecho ocurrido.
