Morrison Mahoney partner Christopher Monson recently obtained summary judgment for a client in a complex product liability case. Chris represented a distributor accused of selling a defective product alleged to have caused the plaintiff's on-the-job injuries. Despite prior sales from the client to the plaintiff's employer, Chris' briefing and oral argument persuaded the Court that there was insufficient evidence to connect the allegedly defective product to our client as a matter of law. The case emphasizes the point that plaintiffs may not rely on speculative guesswork and must present admissible evidence to survive summary judgment.
