Austria: Bauordnungsnovelle 2018: Die Stadt Wien Plant Die Wiener Bauordnung Samt Nebengestzen Bis Ende Jahres Zu Novellieren

Die Novelle hat folgende Eckpunkte: schnellere, einfachere Bauverfahren, Wohnen leistbar zu machen, die gewerbliche Nutzung von Wohnungen zu reduzieren (Stichwort "AirBnB"), und einen verbesserten Klima- und Umweltschutz. Das Ziel der Erhaltung schutzwürdiger historischer Gebäude wurde bereits im Juni beschlossen und trat mit 30.6.2018 in Kraft.

Vereinfachung und Beschleunigung der Verfahren

Im Baubewilligungsverfahren soll die Abhaltung einer mündlichen Verhandlung entfallen, wenn die Nachbarn innerhalb der gesetzten Frist keine zulässigen Einwendungen erhoben haben oder der Bauführung auf den Bauplänen oder unter Bezugnahme auf diese ausdrücklich zugestimmt haben.

Bauvorhaben im Gartensiedlungsgebiet sowie bei Bauvorhaben (Bauklasse I, bebaute Fläche von maximal 150 Quadratmetern) sollen künftig im vereinfachten Verfahren bewilligt werden. Die Bestätigung einer Ziviltechnikerin beziehungsweise eines Ziviltechnikers ist nicht mehr notwendig, da die bautechnische Komplexität bei Bauwerken in dieser Größenordnung gering ist.

Bloße Anzeigepflicht soll in Zukunft erforderlich sein, wenn die Änderung der äußeren Gestaltung eines Gebäudes unwesentlich ist. Bisher galt dies nur, wenn keine Änderung der äußeren Gestaltung erfolgte.

Auch die Planungsverfahren sollen bei unwesentlichen Änderungen vereinfacht werden: Bei einfachen Fällen wie beispielsweise Fluchtlinienanpassungen oder geringfügigen Änderungen der Bebauungsbestimmungen soll in Zukunft die verpflichtende Befassung des Fachbeirates entfallen, die öffentliche Auflage können auf 4 Wochen verkürzt werden, eine nochmalige Vorlage an die Bezirksvertretung kann unterbleiben.

Ferner soll es Erleichterungen bei der Stellplatzverpflichtung geben. Jedenfalls muss aber ein Stellplatz pro 100 m² Wohnnutzfläche vorhanden sein.

Leistbares Wohnen

Es soll eine Widmungskategorie "geförderter Wohnbau" eingeführt werden. Die Grundkosten im geförderten Wohnbau sollen mit EUR 188 pro m² oberirdischer Bruttogeschossfläche limitiert werden. Dieses Grundkostenlimit wird auf Förderungsdauer (das sind 40 Jahre) eingefroren werden, um gewinnbringende Immobilienverkäufe- und Vermietungen zu unterbinden. Ferner soll im Grundbuch ein Veräußerungsverbot der Wohnungen eingetragen werden; ein Verkauf ist somit nur mit Zustimmung der Stadt Wien möglich. Auch eine Weitervermietung darf nur iSd Förderungsrechts erfolgen, somit für EUR 4,87/m² im Jahr 2018.

Die Mindestgröße von Wohnungen soll von bisher 30 m² auf 25 m² herabgesetzt werden. Allerdings ist hier zu beachten, dass gemäß Mietrechtsgesetz eine Wohnung der Ausstattungskategorie A mindestens über 30 m² verfügen muss.

Einschränkung der gewerblichen Nutzung von Wohnungen für Beherbergungszwecke

Die Nutzung von Wohnungen soll für Beherbergungszwecke (Stichwort AirBnB) eingedämmt werden. Eine kurzfristige gewerbliche Nutzung für Beherbergungszwecke findet in Wohnungen üblicherweise nicht statt und steht daher nicht im Einklang mit der Widmung Wohnung".

Schutz von Gründerzeithäusern

Um den Erhalt der historisch wertvollen Bausubstanz auch außerhalb von Schutzzonen zu gewährleisten, wurde bereits im Juni 2018 beschlossen, dass auch der Abbruch von Gebäuden, die vor dem 1.1.1945 errichtet wurden und außerhalb der Schutzzonen und Gebieten mit Bausperre liegen, die Stadt Wien (MA 19) prüfen muss, ob am Erhalt des Gebäudes ein öffentliches Interesse besteht. Für Bauwerke in Schutzzonen und Gebäude, die vor dem 1.1.1945 errichtet wurden, darf die Abbruchbewilligung nur erteilt werden, wenn an der Erhaltung des Bauwerkes infolge seiner Wirkung auf das örtliche Stadtbild kein öffentliches Interesse besteht oder sein Bauzustand derart schlecht ist, dass die Instandsetzung technisch unmöglich ist oder nur durch wirtschaftlich unzumutbare Aufwendungen bewirkt werden kann.

Einkaufszentren

Da Einzelhandelsunternehmen vermehrt auch in Industriegebieten und gemischten Baugebiet - Betriebsbaugebiet angesiedelt wurden, soll in Zukunft für solche Betriebe ab einer Fläche von 1.000 m² die Widmung "Einkaufszentren" erforderlich sein. Dadurch soll der Produktionsstandort Wien gesichert werden.

Klima- und Umweltschutz

Klimaschutz soll als Ziel in die Stadtplanung aufgenommen werden. Die Ziele gemäß § 1 Abs 2 Wr. BauO sind Maßstab für die Gestaltung von Flächenwidmungs- und Bebauungsplänen. Weiters soll die Beschränkung von Emissionen auch Treibhausgas-Emissionen umfassen. Die Dämmung der obersten Geschoßdecke soll bei Gebäudesanierungen verpflichtend werden und i n Wohngebäuden, in denen Heizung/Warmwasser nicht aus alternativen Systemen gespeist werden, soll die Energie aus erneuerbaren Quellen mindestens 20 % des Warmwasser-Bedarfs ausmachen. Weiters soll in Neubauten die Aufstellung und der Einbau von Heizkesseln für feste und flüssige fossile Energieträger nicht zulässig sein.
