WASHINGTON (March 2024) – The United States Supreme Court denied review of a Federal Circuit appeal related to a 2021 Patent Trial and Appeal Board (PTAB) decision in favor of Hamilton Technologies. Patrick Keane, Executive Shareholder of Buchanan and member of Buchanan's Intellectual Property (IP) section represented Hamilton technologies before the Supreme Court. Keane was assisted by Matthew Fedowitz, Ralph Fischer and Erin Napoleon of the Buchanan IP section.

The case stems from global assertions of patent infringement by Dr. Fleur Tehrani. In June, the Court of Appeals for the Federal Circuit (CAFC) found that "none of the issues that Tehrani raised on appeal had merit and only a few warranted discussion." The CAFC decided in favor of Hamilton Technologies, affirming the earlier PTAB decision.

The Supreme Court denial of review furthers the roll out of Hamilton Technologies' innovative INTELLiVENT-ASV® ventilator product line. It also aligns with a previous favorable decision for Hamilton before the United Kingdom's Intellectual Property Enterprise Court (IPEC) in 2022, supporting Hamilton's global IP strategy.
