On September 18, 2018, the USTR issued a press release on the finalization of tariff numbers for goods on Section 301 List 3. The additional tariffs of 10% was effective on September 24, 2018.

On September 18, 2018, the USTR issued a press release on the finalization of tariff numbers for goods on Section 301 List 3. The additional tariffs of 10% was effective on September 24, 2018. List 3 can be found here.

The list contains 5,745 HTS subheadings (down from the original 6,031 subheadings that were originally announced on July 10, 2018). Companies are advised to review the list of HTS numbers to determine if their products are on the list.

President Trump stated that on January 1, 2019 that he will leave the 10% tariffs in place for the List 3 (aka the $200 billion) HTS list. The tariffs will not increase to 25%.

Both Presidents agreed to begin negotiations on structural changes with respect to forced technology transfer, intellectual property protection, non-tariff barriers, cyber intrusions and cyber theft, services and agriculture. The parties agree that they will endeavor to have this transaction completed within the next 90 days (the 90th day is March 1, 2019). If at the end of the 90 days the parties are unable to reach an agreement, the 10% tariffs will be raised to 25%.

The press release did not discuss reducing or ending the 25% tariffs on HTS items on List 1 (aka the $34 billion list) or List 2 (aka the $16 billion list).

Instructions to request an exclusion for HTS subheadings on List 3 have not been published.
