Worldwide: Navigating Aircraft Financing and Leasing: Key Insights for Operators and Lessees

This webinar provides an introduction to aircraft financing and leasing to Philippine operators and lessees. 

What topics are covered:
During the course of such introduction, specific discussions will be made on pitfalls to avoid, proper structuring of the lease (including tax structuring), suggested transaction documents, regulatory and formality requirements, protection of ownership interest, and dispute resolution and remedies.

Who should watch: 
Aircraft owners and lessors. This may also interest aircraft manufacturers.

Why you should watch: 
The Philippines is not a party to Cape Town and discussions will be made on other workarounds to ensure protection of ownership interest. Philippine corporate law also limits “doing business without a license” by foreign lessors and discussions will be made on what this means and how this affects aircraft owners and lessors looking to lease to Philippine operators and lessees.

SPEAKERS
Kerwin Tan

Kerwin Tan graduated from a top law school in Manila and has a Diploma in Law from Sydney University to practice in New South Wales, Australia.He has been practicing for more than 15 years and focuses on aviation, commercial transactions, and tax. Among the notable projects he handled include a national railway government bid (US$2.8B), a renewal energy joint venture worth (US$8.75B), supply of combat helicopters to the Philippine Government (US$240M); various business jets financing and other types aircraft acquisitions. He counsels several air operators, appears before the civil aviation authority, and assists with applications for air transport services.

Eugene Kaw

Eugene Kaw is a former government official having served for 9 years in various senior management capacities in the legislative and executive branches of the Philippine Government, the most recent of which was as Assistant Secretary in the Tourism Department during the Administration of then Philippine President Benigno Aquino III. He specializes in privacy laws, public policy and legislation, government projects and procurement, government affairs and regulations, and tourism development and infrastructure.  His other practice areas include aviation law, commercial transactions, data privacy. He is also a faculty member at several top ranked Philippine law schools.

Fay Kristina Sinocruz-Rutor

Fay Rutor started her career at the Philippine affiliate of Ernst & Young  where she handled contentious tax assessments and moved on to general litigation practice. After a brief stint at the Office of the Speaker at the House of Representative of the Philippine Congress, she is now a member of the Firm advising on aviation, commercial transaction, and industrial law and dispute resolution. She focuses her advisory on commercial transactions from a dispute resolution angle.
