As the UK gets ready to officially leave the EU, and against the backdrop of a global health and economic crisis, the European Commission is turning its attention to dealing with the distortive effects caused by foreign subsidies in the Single Market.
Releasing a White Paper to seek input from stakeholders, the public consultation is open until September 2020 and will help the EU to develop future regulations that touch on several key legal areas for clients: trade law, merger reviews and state aid.
While these areas typically have little or no overlap, the White Paper puts forth the potential for investigations that could involve all three areas, meaning that clients need to be aware of how to navigate the interface between trade and competition issues now to effectively mitigate risk later.

Isabelle is a counsel in Van Bael & Bellis’ Brussels and Geneva offices. She specialises in international trade law (WTO and preferential trade agreements), EU law and public international law, and represents States and individuals before international courts and tribunals.
She has represented WTO Members before WTO panels and the Appellate Body in dispute settlement proceedings.
Isabelle also assists clients on all aspects of the negotiation and implementation of preferential trade agreements and investment agreements and advises clients on questions relating to dispute settlement under preferential trade agreements.
Her experience includes advising in cases relating to Brexit, sanctions, and State aid, among others.
Philippe is the managing partner of Van Bael & Bellis. His practice focuses on international trade and WTO law as well as EU customs law and sanctions.
He has been involved in most major EU anti-dumping, anti-circumvention and anti-subsidy proceedings since 1990, and assisted WTO members in numerous WTO dispute settlement proceedings. He has represented numerous clients before the European Commission, the EU General Court, the Court of Justice of the European Union (formerly the European Court of Justice), WTO Panels and the WTO Appellate Body.
