Day 2's Order of Play was:

Plaintiff's case-in-chief

  1. David R. Bearden, Inventor of U.S. Patent No. 7,523,373
  2. Thomas Conte, Ph.D., Infringement Expert

During day two, the parties continued to pound their themes. Through the direct testimony of an inventor and its infringement expert, VLSI told the jury that the patented technologies were game changing and that Intel uses them to significantly improve speed and reduce power consumption. Intel through its cross-examinations told the jury the opposite—that these patents represent stale technology and neither Intel nor its former owners ever used them in a modern microprocessor.

To learn more about Day 2, please listen to DaWanna McCray and Danielle Williams' interview with Mike Tomasulo, who is in Waco for the trial.
