An employer successfully prevailed upon the trial court to
dismiss an age discrimination case without a trial. The California
Court of Appeal reversed, holding that the "record clearly
raises" triable issues of fact about the former employee's
adequate performance at the time of her termination as well as
whether her termination was a result of her immediate
supervisor's opinion that she wasn't performing adequately
or whether it was due to a discriminatory animus against older
workers, Michelle wrote.
