"It would be difficult to start to cherry-pick types of investments that can and cannot qualify, when the program's existed since 2017 and already had final regulations released," said Lisa Starczewski, an attorney at Buchanan, Ingersoll and Rooney PC, who focuses on taxes and opportunity zones. "There's no question that people can find ways to abuse this program, but it's true of so many different provisions of our tax code."

"I'm not an advocate of throwing the baby out with the bathwater, but we do need to know where the money is going, "attorney Starczewski said.
