статусу
адвоката
жодним
чином не
гарантуватиме
якості
представництва
у
цивільному,
господарському
або ж
адміністративному
процесі
На
сьогодні
законодавство
України не
встановлює
чітких
вимог до
кваліфікації
особи, що
здійснює
представництво
у суді.
Однак
запропонованим
президентом
проектом
змін до
Конституції
України
передбачено
право на
професійну
правничу
допомогу
та
виняткове
представництво
адвокатами
у судових
процесах.
Прихильники
зазначених
змін
впевнені,
що такий
підхід
відповідає
найкращим
міжнародним
практикам
та
сприятиме
підвищенню
якості
судочинства.
Проте
існує і
думка, що
подібні
зміни не на
часі і
призведуть
лише до
обмеження
доступу до
суду та
зниження
конкуренції
на ринку
юридичних
послуг.
