Those injured in workplace accidents (and other accidents) have a legal duty to mitigate their loss and a failure to do so may result in a reduction in their damages. In practical terms, mitigation means accepting employment within their capabilities and reasonable treatment offered. Arguments arise, particularly where there is conflicting medical evidence as to whether a claimant has properly mitigated their loss.
In this interactive seminar, Damian Hinkley and Monique Moloney will explore the principles applied by the courts with respect to the mitigation of loss in personal injury claims and how employers can assist in this process.
