Minneapolis, MN (January 24, 2025) – Lathrop GPM LLP and The Minnesota Department of Employment and Economic Development (DEED) are proud to announce the release of A Legal Guide to Privacy and Data Security 2025, a comprehensive resource designed to help businesses navigate the complex legal landscape of privacy and data security. Authored by Michael R. Cohen, this guide is available free of charge from DEED's Small Business Assistance Office and Lathrop GPM.

The guide covers a wide range of topics related to privacy and data security laws, including federal laws such as the Health Insurance Portability Act, Gramm-Leach Bliley Act, Telephone Consumer Protection Act and the Children's Online Privacy Protection Act, as well as state laws and global laws and regulations. It provides detailed information on the legal basis for privacy rights, specific federal and state laws governing data privacy and security, privacy in the employment relationship, best practices for businesses, and the evolving landscape of privacy laws.

Key highlights of the guide include:

  • FCC Amendments to Telephone Consumer Protection Act: Enhancements to consumers' ability to revoke consent to robocalls and robotexts, effective April 11, 2025.
  • New State Data Privacy and Security Laws: Overview of 16 new state laws related to data privacy and security, including the Minnesota Consumer Privacy Act, effective July 31, 2025. These laws provide rights to residents and consumers and create new obligations for organizations that collect or process personal data.
  • International Privacy Laws and Restrictions on Data Transfers: Overview of recent developments in global privacy laws including the new data privacy framework that allows the transfer of personal data of EU residents to the USA.

The guide also includes a timeline of privacy law developments and sources for further information, making it an invaluable resource for businesses seeking to understand and comply with privacy and data security regulations.

Cohen, the author of the guide, stated, "In today's digital age, organizations that collect or process personal data must be mindful of the many new and emerging data privacy laws that create enhanced rights for individuals and increase compliance obligations for organizations. This guide is written for non-lawyers who seek a better understanding of the complex landscape of privacy laws and regulations and includes best practices to help businesses and organizations minimize risk and maximize customer and member trust."
