CMS has advised Aviva Investors on the legal and tax aspects of the set-up and launch of The Aviva Investors Carbon Removal Fund.
This Luxembourg fund has been designed to provide institutional investors – including corporates, pension funds, insurers and local government pension schemes – with access to carbon removal solutions which aim to deliver investment returns whilst also supporting their long-term net zero ambitions. It will invest directly in both nature-based and engineered carbon removal solutions such as afforestation and restoration projects, venture capital and private equity-based nature tech, and alternative carbon removal companies.
CMS acted as lead counsel in relation to the fund structuring and establishment, advising on legal, regulatory and tax aspects, including the preparation of the documentation of fund terms with an Investment Funds team made up of Aurélien Hollard (Partner), Julia Bruzzese (Partner), Gilles Bropsom (Counsel), Céline Delinte (Senior Associate), Tristan Louet (Managing Associate) and Julie Pelcé (Senior Associate) with respect to ESG/SFDR matters. They were supported by Frédéric Feyten (Partner), Alejandro Dominguez (Senior Counsel) and Vicente Chapa (Managing Associate) for the tax aspects.
