Benjamin Beck kommentiert die Entscheidung des OLG Düsseldorf zur vorausgesetzten Gleichwertigkeit des Ersatzmittels bei einer äquivalenten Patentverletzung. Für die Frage der Orientierung der fachmännischen Überlegungen am Patentanspruch sei u.a. zwischen solchen Merkmalen zu unterscheiden, die aus der Sicht des Fachmanns „stellvertretend“ für ein bestimmtes technisches Wirkprinzip stehen, und solchen, die sich überhaupt nur auf die dem Wortsinn entsprechende Weise umsetzen lassen.
