L’Office de la propriété intellectuelle du Canada (l’« OPIC ») a annoncé une prolongation générale supplémentaire de tous les délais fixés aux termes de la Loi sur les marques de commerce, de la Loi sur les brevets et de la Loi sur les dessins industriels  :  tous les délais fixés entre le 16 mars et le 30 avril ont été automatiquement prolongés jusqu’au 1er mai 2020.

The Canadian Intellectual Property Office (“CIPO”) announced a further blanket extension of all deadlines fixed under the Trademarks Act, the Patent Act, and the Industrial Design Act:  all deadlines falling between March 16 and April 30 have been automatically extended to May  1, 2020.

The Canadian Intellectual Property Office (“CIPO”) has recently taken action to accommodate COVID-19 related delays and interruptions to businesses.  On March 27, 2020, CIPO announced a further blanket extension of all deadlines fixed under the Trademarks Act, the Patent Act, and the Industrial Design Act, such that all deadlines falling between March 16 and April 30  have been automatically extended to May  1, 2020. 

CIPO has also made clear that the new deadline of May  1 may be further extended if warranted by circumstances. 

Of note, although CIPO and its online solutions continue to operate as normal, CIPO warns that applicants and rights holders can expect significant delays in respect of all CIPO services.

However, this further extension of time is a welcome safety buffer for applicants and registered rights holders who are currently working hard to address the business realities arising from COVID-19.
