Canada Corporate/Commercial Law

As the deadline for compliance fast approaches, the Canadian Radio-television and Telecommunications Commission (CRTC) has issued another Compliance and Enforcement Information Bulletin – CRTC 2014-326 providing guidance to businesses to assist them in developing corporate compliance programs for the pending application of Canada' anti-spam legislation or CASL.  Compliance with the legislation, which starts to come into force on July 1st, is an important objective for organizations that are likely to be sending Commercial Electronic Messages or CEMs. The Bulletin reviews why a corporate compliance program is important and outlines the components that such a program should have.

Non-compliance with CASL may expose an organization and its directors to significant administrative monetary penalties (AMPs) and related costs, not to mention the reputational damage that could be associated with a finding that the organization has been "spamming".
