On May 24, 2013, the Ontario Superior Court of Justice released
its decision to dismiss the class action certification motion in
the matter of Sherry Good v. Toronto Police Services Board and
Attorney General of Canada, Her Majesty the Queen in the Right of
Ontario, and Regional Municipality of Peel Police Services
Board.
In a detailed decision, the Court found that the claim could not
proceed as a class action. The proposed claim failed to meet the
criteria for certification. Many of the pleaded causes of action
were flawed and the commonality of issues required for
certification was not established.
